Know the Code - Building a Fence

Whether you're adding a new fence to your property or replacing an existing fence, it's important to know the city code and guidelines before beginning, or it may lead to a costly situation.

Where can I build a fence?
Nothing is more important than location when building a fence. An improperly located fence can result in friction between neighbors, ordinance violations, lawsuits, or even the need to move your fence. To avoid these costly and frustrating problems, your fence must be located entirely inside your property line. It is your responsibility to know where your property line is. Even when replacing an existing fence, always verify that the original fence was built to code and is inside your property line. Fence locations must also comply with the following:

  • Fences must be constructed to allow utility company personnel access to utility meters on the property.
  • Fences can not be located or constructed in a manner that would block or alter drainage patterns or restrict access to ponds and easements.
  • Fences must be set back a minimum of three feet from existing or planned sidewalks or trials.

How high of a fence can I build?
Fencing on side and backyards can be up to six (6) feet in height. However, fencing extending across a front yard cannot be taller than four (4) feet in height and must be at least 75% open space, so it does not block views or light.

Is a permit required?
The City does not require a permit to construct a fence six feet in height or less. However, all code requirements apply even if a permit is not required.

What materials can I use?
Fences must be constructed of durable materials designated for permanent outdoor fencing. This includes:

  • Vinyl
  • Wood or composite
  • Chain link with a minimum nine-gauge thickness and a top rail

Materials such as chicken wire, barbed or electric wire, rope, cable, timbers, pallets, or other material intended for other purposes are not allowed.

All fences must be maintained on both sides and remain in a condition of good repair. The finished side of a residential fence must face the neighboring property.

Anytime you have a project involving digging holes in your yard, you must call Gopher State One at 811 to prevent damage to underground utilities. Call at least 48 hours before you intend to dig.
